自由 freedom とは、"自律autonomy "の異名、といった哲人がいます。
ピルグリムファーザーズが、メイフラワー号から上陸する前に盟約がなされたようで
すし、Puritan Separatist として、自由の天地を求める前に、敬虔なプロテスタン
ト達は、はじめに誓約ありきというか、Self Regulative な、規約を作って上陸して
います。新世界は、幾つもの原則、規律を、自らに課する事から始まったと言っても
過言ではなかったかと思います。
現在日本で謳歌している "自由"は、何でもやって良いという License とは違うはず
だと理解はしても、野放し状態ではないかと思うくらいに、Egotism か、あるいは、
Ido-ism (私の造語) 社会かと感じてなりません。さて、
自由権的基本権、社会権的基本権に次いで、現代は、第三世代の人権宣言を要求され
ると言われています。地球環境問題は、権利と言うよりは"神聖な義務"だと思われま
すし、障害者、弱者、患者の権利宣言をはじめとして、全人的な尊厳を守り、Syn-
active とPT今川氏が言われるような、共生社会を目指すためにも、標題の問題、大
きな課題であるわけでしょう。
患者の権利宣言も、まずは ボトムアップで、ローカルに、各施設で自律的に宣言す
るところから、始めるべきでしょう。特に、日本の民主主義は輸入するもの、受け入
れるものになりやすいので、"自律性"が、私たちにはキーワードです。
職業人が、倫理規範 Code of Ethics を文書としてきちんと職場に掲げるのは
Hippocrates の宣詞 の精神からも当然として、その上で、Patient's Bill of
Rights には、項目として、どのようなものが含まれるべきなのでしょう？

研究に参加する場合などは、Written Informed Content が要求されますね。
Second Opinion は、自由に選べるべきでしょう。
Yes-man にならざるを得ない日本医療で、検査や、治療を拒否できる権利は、ありま
すか？
医療過誤事例で、公平な裁判を受ける権利も保障されるでしょうけれど、"白い巨塔"
はどうしても、産学共同体が緊密に連携して守ってしまい、ある専門家群、施設・組
織の存続が、経営原理として自己目的化してしまいがち、日本では。
このあたり、日々考えないではないのですが、今まで全く踏み込んだ事のない領域な
のです。

APTA Applauds New Patients' Bill of Rights
Strong patient protections that will ensure timely access to high-quality
health care for millions of Americans would be provided by a new "Patients'
Bill of Rights," according to a bipartisan, bicameral group of federal
legislators who introduced the bill earlier this week.
The protections provided to all Americans with private health insurance
coverage, either through employers or the individual market would include
access to emergency care, access to specialty care, access to non-formulary
drugs, access to clinical trials, direct access to pediatricians and
ob-gyns, continuity of care for those with ongoing health care needs, and
access to important health plan information. The bill also protects the
provider-patient relationship by ensuring that health professionals are free
to provide information about a patient’s medical treatment options.
APTA supports the bill, which was introduced by Congressmen John Dingell
(D-MI) and Greg Ganske (R-IA), and Senators John McCain (R-AZ), Edward
Kennedy (D-MA), Lincoln Chafee (R-RI), John Edwards (D-NC), and Bob Graham

"Congress needs to act now to ensure that all Americans receive the quality
of care that they deserve under managed care," APTA President Ben F Massey,
Jr, PT, said in a recent news release. "The standards contained in this bill
are not a radical reform of our health care system; rather, they are a set
